Where the Sex Offender Registry Board determines that the risk of re-offense by an offender is low and the degree of dangerousness posed to the public by that offender is not such that a public safety interest is served by public availability, the Board shall give that offender a Level 1 designation.

Organizations in the community that are likely to encounter the sex offender include, but are not limited to, public and private organizations, areas and establishments which provide services of any type to children, the elderly, or other vulnerable members of the population.

A similar problem exists with recording up to date addresses for sex offenders who fail, in violation of the law, to register with the board, and SORB must rely on local law enforcement to track them down. At the time of the audit, the SORB registry held records for 21, convicted sex offenders, of which 13, were living in Massachusetts communities.
